VARIATIONS OF THESE TERMS AND CONDITIONS
These conditions are subject to variation at any time.
Any variation will be displayed here and you will be deemed to have accepted a variation if you have made a booking after it has been displayed.
These Conditions and any appendices shall take effect on the date displayed above until further notice, or as superseded by later versions.
PASSPORTS & VISAS
The Client is responsible in ensuring passports are valid prior to departure, for at least 6 months after the return date to the home country. The client is responsible to purchase a valid VISA on time, depending on the country of origin. For more info Tanzanian visa official web page
Attention: if either visa or passport of the client are not valid at the entrance in Tanzania, the deposit paid to AfriKili Adventure cannot be returned to the customer.
QUOTE
Our price estimates and quotations are offered without obligation. Price might vary until when the travel is paid in full. We cannot be held responsible for faults, omissions or miscalculations in price quotations, by us, or by third parties. Price estimates and quotations are subject to change. After the conclusion of the contract, the client may have to bear additional fees, charges and other costs payable to third-parties that we could not reasonably calculate or know at the time of the conclusion of the contract, such as resort fees, tourist taxes, entrance fees, and so. In particular Government Park fees can substantially vary any time and such price variation is not under AfriKili Adventure control. Such possible fees and extra-charges due to third party price variation, and not included in our offers, and are payable directly to the third when possible.
CURRENCY CONVERTER
The conversion rate used by AfriKili Adventure is provided by Barclays Bank Tanzania. Currency quotes are not updated every day and MIGHT VARY on a daily basis.
BOOKINGS AND RESERVATIONS
When a ticket, tour or other service is reserved, AfriKili Adventure sends an email confirming the booking (A booking fee may be charged). The client is responsible to examine tickets carefully upon receipt. Both the Provider and Afrikili Adventure accept no liability for ticket errors resulting from incorrect information provided by you.
If there is any inaccuracy, the Provider must be notified within 24 hours of receipt of your tickets. Once reservations are confirmed, any modification/alterations initiated by the traveller must be received at least 24 hours in advance of said change and may be subject to additional costs.
The Provider aims to ensure that all tickets booked through AfriKili Adventure are issued correctly and efficiently but in the event of any error or delay occurring in connection with the booking or the issue of tickets, the maximum liability to the Client or Customer will be to refund the price of the ticket, notwithstanding these terms and conditions.
Names on travel documents MUST match exactly those shown on passports and AfriKili Adventure is not liable for having a mismatch between ticket and passport.
If an e-ticket has been provided, it must be taken when travelling as it may be required on demand. Customers should also have a passport and visa during travel at any time.
Booking of full packages and tours EXCLUDE
- The price of flight ticket from your home country, unless expressively written otherwise.
- Items of personal nature, soft drinks, personal travel insurances and evacuation fees, visas and transit visas.
- Tips to the assisting stuff (highly recommended – customary the Chief guide gets US$ 15 a day, the assistant guide and cooker USD $10 per day, the porters USD $8 per person per day)
AfriKili Adventure acts as a sales agent for airline, hotel, car-rental company, tour operator, cruise line, or other service provider named in your itinerary (“Suppliers”). AfriKili Adventure is not responsible for acts or omissions of the Suppliers or their failure to provide services or adhere to their own schedules.
AfriKili Adventure assumes no responsibility for and shall not be liable for any refund, personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be caused by:
(1) any defaults, wrongful or negligent acts, or omissions of the Suppliers;
(2) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated, or otherwise used or provided by the Suppliers;
(3) any wrongful or negligent acts or omissions on the part of any other party not under AfriKili Adventure’s control;
(4) any Supplier price drop after your travel arrangements have been confirmed, paid in full, or ticketed.
You hereby release AfriKili Adventure from all claims arising out of any problem covered in this paragraph.
Travel arrangements involving airline, cruise components and entrances to National Parks are subject to supplemental price increases that may be imposed by the supplier and/or government after you have completed your purchase. You hereby consent to any such price increases and authorize your credit or debit card to be used for them, after AfriKili Adventure inform you. Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and you may be bound by those contracts regardless of whether you receive notice of their terms.
AfriKili Adventure has no special knowledge regarding the financial condition of the Suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel. INSURANCE
For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance.
You understand and agree that during your travel, there will be medical risks inherent in such travel, such as risks of negligence by physicians, hospitals, and other providers of medical services. In consideration of AfriKili Adventure work in making travel arrangements, YOU EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD AfriKili Adventure and its agents, employees, officers, directors, associates, affiliated companies, and subcontractors HARMLESS against any and all liability, actions, causes of action, debts, suits, claims, and medical demands of any and every kind and nature whatsoever which you now have or which may hereafter arise out of or in connection with your trip. THE TERMS OF TRAVEL AGREEMENT SHALL SERVE AS A COMPLETE RELEASE AND EXPRESS ASSUMPTION OF RISK for yourself, your heirs, assignees, administrators, executors, and all members of your family, including any minors accompanying you. YOU will be asked to sing a release contract in which you declare that you HAVE READ AND FULLY UNDERSTOOD THE PROVISIONS AND THE LEGAL CONSEQUENCES OF THIS RELEASE AND ASSUMPTION OF RISK, AND YOU HEREBY AGREE TO ALL OF ITS CONDITIONS.
ADVENTURE EXCURSIONS
During the trek, tour, expedition, or other trip in which the client will participate, under the arrangements of AfriKili Adventure, and its agents, employees, associates, affiliated companies, or subcontractors, certain risks and dangers may arise, including, but not limited to, acts of God, the hazards of travelling in unsafe or politically unstable areas or under unsafe conditions, the dangers of civil disturbances and war, the forces of nature, dangers and risks inherent in sporting activities, the negligent or reckless acts or omissions of AfriKili Adventure, its agents, employees, officers, directors, associates, affiliated companies, or subcontractors, travel by boat, automobile, train, ship, aircraft, or other means of conveyance, and accident or illness in remote places without access to medical facilities, transportation, or means of rapid evacuation and assistance. AfriKili Adventure shall not be responsible for any injuries, damages, or losses caused to any traveller in connection with any of the above and/or terrorist activities, social or labour unrest, mechanical or construction failures or difficulties, diseases, local laws, climatic conditions, abnormal conditions or developments, or any other actions, omissions, or conditions outside the travel agent’s control. Travellers assume complete and full responsibility for the above mentioned events and EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD AfriKili Adventure and its agents, employees, officers, directors, associates, affiliated companies, and subcontractors HARMLESS against any and all liability, actions, causes of action, debts, suits, claims, and demands of any and every kind and nature whatsoever which have or which may hereafter arise out of or in connection with the participation in any activities arranged by AfriKili Adventure and its agents, employees, associates, affiliated companies, or subcontractors.
FOOD
AfriKili Adventure follows strict hygienic procedures to mitigate any risk of food poisoning during the tour. For example all the food served by our staff is cooked and not raw, fruit and vegetables accurately washed, water served is packed or filtered if sourced by natural water springs. During the gastronomic tour, the food will be prepared and served by third parties and AfriKili Adventure has NO control on their preparation techniques and the use of ingredients. During the gastronomic tour, alcoholic beverages might be served upon client request. The client is responsible for drinking responsibly and AfriKili Adventure reserves the right to interrupt the tour with NO reimbursement if the client shows disruptive and uncontrollable behaviour that cause stress to other guests or to the staff.
The client has the responsibility to disclose any and all food allergies, dietary restrictions, and
medical health concerns via email or in person prior to tour commencement. However, food that AfriKili Adventure serves is locally produced and prepared and it might contains components to which the body of travellers are not used, causing nausea and digestive system stress. Moreover, our menus include peanuts, tree nuts, soy, milk, eggs and wheat. While we take steps to minimise the risk of cross contamination, we cannot guarantee that any of our products are safe to consumer for people with peanut, tree nut, soy, milk, egg or wheat allergies.
THE CLIENT MUST DECLARE TO UNDERSTAND ALL THE RISKS ASSOCIATED WITH CONSUMING FOOD AND BEVERAGES DURING THE EXCURSIONS, ACCEPTING SOLE RESPONSIBILITY FOR FOOD SICKNESS, ALLERGIC REACTION AND DEATH. Travellers EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD AfriKili Adventure and its agents, employees, officers, directors, associates, affiliated companies, and subcontractors HARMLESS against any and all liability, actions, causes of action, debts, suits, claims, and demands of any and every kind and nature whatsoever which have or which may hereafter arise out of or in connection with the consumption of any food and beverages arranged by AfriKili Adventure and its agents, employees, associates, affiliated companies, or subcontractors.
HIKERS WHO CHOOSE GUIDE-ONLY TOURS
By adhering to a “guide-only tour” the client represents that he/she is in good health, in proper physical condition, and capable of walking long distances outdoors. The client also declares that he/she is sufficiently self-aware to stop physical activity before I become ill or injured.
The client is encouraged to wear proper clothing, use sunscreen, and stay hydrated throughout the all length of the excursion. In particular the Client must be aware that on the top of Kilimanjaro the temperature might go as low as -20 degrees Celsius and therefore proper equipment is required, including but not limited to thermal layer, middle woollen layer and shell resistant to extreme weather condition. For multiple days excursions the gear pack of the client will be checked prior departure, and must include above-mentioned clothing, sleeping bag with comfort temperature -5 degrees Celsius or below, tent (where required), cooking pot and stove, at least 4 litres water capacity, sun screen, sunglasses, head covering garment, and headlamp.
ATTENTION: FOR KILIMANJARO PARK REGULATIONS, THE OVERALL BACKPACK OF INTERNATIONAL VISITORS MUST BE BELOW 12 KG OF WEIGHT EXCLUDING WATER AND FOOD. This is for traveller safety and mitigation of risk of accident of international visitors. Please note, the backpack will be weighted at the entrance of the park and if exceeding the weight, the visitor might be asked to hire a porter. This is absolutely not under AfriKili Adventure control and the cost incurring in the hiring of a porter is completely accredited to the client.
Important note: also in tours defined “guide only tours”, 1 porter will be hired for each customer to carry emergency equipment, food and water for the last base camp where there is not natural source of water. The client is required to resupply food for the entire length of the excursion and it will be his/her sole responsibility to prepare it. The client will be required to have enough fuel in order to cook for the all length of the trip. RESUPPLY FOOD WEIGHT CANNOT EXCEED 1kg per day per person. The food will be carried by the porter, while water must be carried by the client. Porters cannot carry more than 20kg (beyond the weight of their personal gears), According with Park regulations, and their backpack will be weighted at the entrance of the park. If food for the client exceed the weight of 1kg per day per person, the excess might be left at the entrance or a further porter will be hired. This is absolutely not under AfriKili Adventure control and the cost incurring in the hiring of a porter is completely accredited to the client. Moreover, the tourist-to-guide ratio is established by the Park regulations and cannot be negotiated.
If while on the tour the client start to feel faint or nauseous, he/she will notify immediately the tour guide. The client must understand and agree that tour guide reserves the right to disqualify anyone at any time during the tour if he or she feels the tour participant is incapable and/or if a tour member’s continued participation will jeopardize the individual involved or the group. Refunds are not given under such circumstances.
The client must understand the risk associated with the “guide only” tours and that his/her safety is his/her sole responsibility. The client must understand while on the tour he/she may become injured or harmed and travel insurance is highly recommended. (Rescue cost in case of life endangerment is included in the tour package). The travellers assume complete and full responsibility for the above mentioned events and EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD AfriKili Adventure and its agents, employees, officers, directors, associates, affiliated companies, and subcontractors HARMLESS against any and all liability, actions, causes of action, debts, suits, claims, and demands of any and every kind and nature whatsoever which have or which may hereafter arise out of or in connection with the participation in any activities arranged by AfriKili Adventure and its agents, employees, associates, affiliated companies, or subcontractors.
REFUNDS AND CHANGES TO TICKETS AND TOURS
Unless indicated otherwise in the specific terms that apply to the ticket, it is only valid for travel at the times stated on it and may not be exchanged.
If the Provider makes any change to or cancels the booking, the Provider’s maximum liability may be the refund of the ticket price, and only when expressly written on the ticket. Otherwise the refund is not possible because of third party charges to AfriKili Adventure for the ticket booking. If the ticket is refundable, AfriKili Adventure reserves the right to charge a processing fee of up to 20% of the cost of the ticket. The Provider may charge a processing fee. The processing fees made in respect of exchanges and cancellations, if AfriKili Adventure is involved in their administration, are in addition to any charges that may be made by the Provider concerned.
For trek trips, should a trekker refuse to use all or some services or should the trek be interrupted due to the violation of local legislation on the part of the trekker or for other reasons, no reimbursement for not provided services is made.
Refunds on partially-used tickets and deposits are not available
